DIGITAL PRODUCT LICENSE AGREEMENT, COPYRIGHT NOTICE & TERMS OF SERVICE

PLEASE READ THIS AGREEMENT CAREFULLY BEFORE PURCHASING, DOWNLOADING, ACCESSING, OR USING ANY WITCHYCHIGURL DIGITAL PRODUCT.

This Digital Product License Agreement ("Agreement") is a legally binding contract between WitchyChiGurl ("Company," "we," "our," or "us") and the purchaser ("Customer," "you," or "your").

By purchasing, downloading, accessing, or using any digital product sold by WitchyChiGurl through our website or any authorized third-party marketplace, you acknowledge that you have read, understood, and agree to be legally bound by this Agreement and our Terms of Service. If you do not agree to these terms, you must not purchase, download, access, or use any WitchyChiGurl digital product.

ARTICLE I — OWNERSHIP OF INTELLECTUAL PROPERTY

All WitchyChiGurl digital products and proprietary content, including but not limited to:

(collectively, the "Content") are and shall remain the sole and exclusive intellectual property of WitchyChiGurl.

The Content is protected by the United States Copyright Act (17 U.S.C. §§ 101 et seq.), applicable trademark laws, trade dress laws, international copyright treaties, and all other applicable intellectual property laws.

No ownership rights are transferred through the purchase of any digital product. Your purchase conveys only a limited license to use the Content under the terms of this Agreement.

ARTICLE II — LIMITED LICENSE

Subject to compliance with this Agreement, WitchyChiGurl grants you a limited, personal, revocable, non-exclusive, non-transferable, and non-sublicensable license to access and use the purchased Content solely for your own personal, non-commercial use.

This license does not constitute a sale or transfer of ownership of any intellectual property.

ARTICLE III — PROHIBITED USES

Except with the prior express written consent of WitchyChiGurl, you shall not:

• Copy, reproduce, duplicate, photograph, scan, trace, redraw, digitize, recreate, or otherwise replicate any portion of the Content.

• Share, forward, distribute, upload, post, email, publish, display, or otherwise make the Content available to any third party.

• Sell, resell, sublicense, license, rent, lease, lend, assign, gift, or otherwise transfer any WitchyChiGurl Content.

• Modify, adapt, translate, edit, reverse engineer, extract, or create derivative works from any WitchyChiGurl Content.

• Use any WitchyChiGurl Content, including sigils, magical seals, rituals, spellwork, artwork, graphics, or written materials, for commercial purposes without prior written authorization.

• Upload or incorporate any WitchyChiGurl Content into AI models, machine-learning datasets, generative AI systems, prompt libraries, digital archives, online repositories, membership sites, educational platforms, cloud-sharing services, print-on-demand platforms, NFT collections, or file-sharing websites.

• Remove, obscure, alter, or circumvent any copyright notice, watermark, trademark, logo, proprietary symbol, or identifying mark contained within the Content.

Unauthorized copying, tracing, recreation, redrawing, digitization, commercial exploitation, or redistribution of WitchyChiGurl Content constitutes a material breach of this Agreement.

ARTICLE IV — COPYRIGHT ENFORCEMENT

WitchyChiGurl actively monitors and enforces its intellectual property rights.

In the event of unauthorized use, WitchyChiGurl reserves the right to pursue any remedies available under applicable law, including but not limited to:

• Digital Millennium Copyright Act (DMCA) takedown notices

• Copyright infringement claims

• Marketplace infringement reports

• Cease-and-desist demands

• Injunctive relief

• Recovery of actual damages where available

• Recovery of attorneys' fees and costs where permitted by law

• Suspension or termination of user access or licenses

• Any other legal or equitable remedy available under federal, state, or international law

Nothing in this Agreement shall be construed as limiting WitchyChiGurl's legal rights or remedies.

ARTICLE V — NO REFUNDS

Due to the nature of digital products, all sales are final.

Once a product has been delivered or made available for download, no refunds, returns, exchanges, or cancellations will be provided except where required by applicable law.

ARTICLE VI — DISCLAIMER

All WitchyChiGurl products are provided for educational, informational, personal development, and spiritual exploration purposes only.

WitchyChiGurl makes no guarantees regarding personal, financial, legal, medical, psychological, or spiritual outcomes resulting from the use of any product.

Individual experiences may vary.

Nothing contained within any WitchyChiGurl product shall be construed as legal, medical, financial, psychological, or other professional advice.

ARTICLE VII — TERMINATION OF LICENSE

Any violation of this Agreement immediately and automatically terminates the license granted to you without notice.

Upon termination, you must immediately cease all use of the Content and destroy any unauthorized copies in your possession or control.

Termination does not waive WitchyChiGurl's right to pursue legal remedies for prior or ongoing violations.

ARTICLE VIII — GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of Illinois, without regard to conflict-of-law principles.

Any legal action arising out of or relating to this Agreement shall be brought exclusively in the appropriate state or federal courts located within that jurisdiction, and you consent to the personal jurisdiction and venue of those courts.

RESERVATION OF RIGHTS

All rights not expressly granted in this Agreement are reserved exclusively by WitchyChiGurl.

No implied license, waiver, or transfer of rights shall arise from the purchase or use of any WitchyChiGurl product.

Unauthorized use is strictly prohibited and will be pursued through all available legal remedies.

No Guarantees or Warranties

All services and products provided by WitchyChiGurl are offered without any guarantees or warranties.

Clients understand that results, experiences, and outcomes vary.

WitchyChiGurl is not responsible for decisions, actions, interpretations, expectations, or outcomes resulting from any service, product, consultation, conversation, reading, ritual, or event.
